Yoga disclaimer

Body and Mind Therapy: Yoga Student Disclaimer and Waiver

This disclaimer and waiver applies only to the yoga strand of Body and Mind Therapy — individual yoga sessions, small group yoga, and yoga courses and workshops. It does not apply to psychological therapy, which is covered by its own sections of the terms and conditions. By booking a yoga class with Body and Mind Therapy, you confirm that you have read and understood this student disclaimer and waiver.

Inherent risk and your health

You acknowledge that sessions may be physically strenuous, and that you participate voluntarily with full knowledge that, as with any exercise programme and use of specialist equipment, there is an inherent risk of personal injury or illness even where reasonable care is taken.

Certain activities may be unsuitable for you if you have special needs, or any medical, health or fitness problem or condition.

You must ensure that you are fit and well enough to participate in any yoga session that you book, and you are at all times responsible for knowing your own state of health, physical condition and wellbeing, for working within your own limits, and for telling the teacher about anything that may affect your safe participation. Advice provided during a session does not constitute medical advice and is not a substitute for advice from the medical professional responsible for your healthcare. If you have any concerns about your fitness or health, you should seek appropriate medical advice before attending, and obtain written consent from your healthcare professional where necessary.

You confirm that you have no health or fitness problems (including, but not limited to, cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma or other breathing difficulty; diabetes; epilepsy; or an allergy) which may affect your participation in any yoga session — or that, where you do, you have disclosed them as set out below.

Liability

To the extent permitted by law, Body and Mind Therapy accepts no liability for injury, illness, or loss of or damage to personal property arising from the inherent risks of participation in a yoga class, workshop, event or activity, or from your failure to disclose relevant health information, follow instructions, or work within your own limits. Nothing in this disclaimer excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited. Your statutory rights as a consumer are unaffected.

What you must tell Body and Mind Therapy

You confirm that you understand you must tell Body and Mind Therapy:

  1. of any medical condition, or any medication you are taking, which may affect your ability to undertake any activities at a yoga session or to use any equipment or facilities provided;
  2. of any circumstances affecting your health which may be worsened by any activities at a yoga session;
  3. if you are pregnant.

You will be informed if a booking cannot be accepted because of a medical, health or fitness issue or special need.

During yoga sessions

You must not attend any yoga session when under the influence of alcohol or illegal drugs, or immediately following a heavy meal.

You should not attempt to use any equipment or facilities until the teacher, or another suitably qualified teacher, has instructed you in their correct use. You may only use the equipment and facilities provided in the correct manner, and must not use them in any way that creates a health and safety risk to you or to others.

From time to time during yoga classes, the teacher may offer to physically adjust students' form and posture. If you do not want physical adjustments, please tell the teacher at the start of each class you attend. If you do wish to receive adjustments, it is your responsibility to tell the teacher when an adjustment has gone as far as you would like.

Please take care of your personal property during classes and other events — it remains your responsibility.

Online + Virtual Classes

If you are attending an online or virtual yoga class, you must be based in the UK.

If practising from home, you accept responsibility for your space and the health and safety precautions within it. You will ensure the space you are practising in is clear of any obstacles, such as coffee tables, rugs and other furniture, to avoid the potential for injuries. Body and Mind Therapy cannot supervise or control a home practice space, and — subject to the “Liability” section above — does not accept responsibility for injuries arising from the condition of a practice space outside the studio.

You understand that services offered by Body and Mind Therapy are not a replacement for talking or psychological therapies; medical or pharmaceutical interventions; or any other forms of treatment recommended to individuals currently awaiting or under the care of a mental health service or other health professionals. Classes, wellbeing activities and exercise programmes offered by Body and Mind Therapy aim only to act as a complement to other professional therapeutic interventions or treatments for individuals experiencing mental health difficulties.

By booking a yoga class, course or workshop with Body and Mind Therapy you are declaring you have read and understood the above statement, and agree to its contents.
